WHAT WILL THIS FREE SEMINAR COVER?
As the world inches closer to key climate deadlines of 2030 and 2050, countries likely to be severely impacted by the adverse effects of climate change have sought to clarify States’ obligations under international law in respect of climate change, using advisory opinion proceedings in various international fora.
Join us for a first-hand account from DLA Piper on the critical role of States in advisory opinion proceedings on climate change before international courts and tribunals, including their initiation, litigation, and implementation. This seminar will also consider some of the practical realities of participating in an advisory opinion and representing Small Island Developing States and Least Developed Countries, and the potential implications of the advisory opinions at both international and domestic levels.
The DLA Piper team are representing the Governments of Timor-Leste, Tonga, Solomon Islands, and Zambia before the International Court of Justice in its advisory opinion on States’ obligations in respect of climate change. The team also represented the Government of Timor-Leste before the International Tribunal for the Law of the Sea in its advisory opinion on State’s obligations to protect the marine environment in the context of climate change.

PRESENTERS:
Stephen Webb is an international law and projects partner with significant experience across maritime, energy and infrastructure projects and disputes. He often leads multi-jurisdictional and disciplinary teams to devise and implement strategy on complex problems or projects. In recent years his focus has been on resolving maritime boundary disputes, special economic zones, international treaties and the renewable energy sector, as well as complex transport and infrastructure projects.
Gitanjali Bajaj is a dispute resolution partner with over 15 years’ experience in high-value and complex cross-border disputes in the energy and resources, defence, maritime and infrastructure sectors. Gitanjali’s practice canvasses international commercial arbitrations for public and private sector clients, and public international law and dispute resolution between States, with Gitanjali having acted on several high profile and politically sensitive matters, including, the first ever UNCLOS Compulsory Conciliation for the maritime boundary dispute between Timor-Leste and Australia, the termination of the Australian Future Submarine Program, the ITLOS Climate Change Advisory Opinion, and the ICJ Climate Change Advisory Opinion.
Claire Robertson advises governments on international law matters and dispute resolution between States on complex issues, including on issues related to climate change, law of the sea, and economic diversification. She also advises governments on climate finance projects, in particular supporting ocean-related initiatives.
Riley Arthur advises and represents vulnerable individuals, non-governmental organisations, charities, community groups and sovereign States in various matters on a pro bono basis, with particular focus on human rights, forcibly displaced persons and access to justice.
